Estate Planning

Protect your assets for your family with an Estate Plan to make sure your wishes are known and followed. We assist clients in creating legally binding documents that accurately reflect their wishes and help ensure that their assets are distributed according to their desires.

Basic estate planning documents include the following:

  • Last Wills and Testaments:  A Last Will and Testament is a legal document that explains when and how your beneficiaries will inherit your property and assets. It should also name your choice of an executor, sometimes called a personal representative.
  •  Revocable Living Trusts: A revocable living trust—sometimes called a living trust—is a legal entity created to hold ownership of an individual’s assets
  • Financial Power of Attorney: Financial power of attorney is a legal document that enables a designated person to handle another person’s financial affairs.
  • Medical Power of Attorney: This document lets you legally name someone as your health care agent/proxy to make health care decisions for you if you cannot make them for yourself
  • HIPAA Authorisation: This gives your written consent for doctors to discuss your medical situation with others.
  • Living Will: This simple document lets your doctors know the kind of life support treatment you would want in case of a terminal illness or injury when death is imminent.

FAQs

First and foremost, for the benefit of all parties involved, do your best to get a current ID by visiting the Texas Department of Motor Vehicles. If that is not an option, in Texas we can utilize a Credible Witness to verify your identity. A credible witness must either personally know the Notary or the signer well enough to be able to swear or affirm the signer’s identity before the Notary. A Credible Witness must present to the Notary a valid, unexpired ID issued by the federal or a state government that contains the photo and signature of the witness

Any current U.S. government-issued identification is considered an acceptable form of ID. This includes drivers’ licenses, military IDs, and state-issued identification cards and a U.S. Passport.

Probate is the legal process for distributing a person’s property after they pass away. During this process, the court validates the will, pays off any debts, and transfers the remaining property to the heirs. If there is no will, the estate may still need to go through probate. It is important to note that the probate process is public, can be expensive, and often takes a considerable amount of time..

An estate plan outlines how to manage assets and wealth during your lifetime and after your passing. It is created based on your financial situation, goals, and the financial circumstances of your heirs and beneficiaries.

A will serves as a fundamental document that provides clear instructions on how to distribute your property and assets to your loved ones after you pass away. If you die without a will, your assets will be distributed according to state intestacy laws. In that case, a court and judge will determine who receives your assets, and this process can vary by state.

Creating an estate plan allows you to maintain control over your assets—regardless of what happens. A clear and legally valid estate plan protects your loved ones and ensures that your wishes are honored. If you choose not to take control, your state’s laws will dictate the distribution of your assets.

Technically, there is no perfect age to start planning your estate. One key milestone, though, that typically sets the process in motion is when an individual or couple has a child. New parents will want to consider estate planning, in that if something were to happen to one or both of them, the child’s welfare will need to be taken into account. As your life and financial priorities become more complex with age, and your assets change, you will need to consistently review your estate plan to ensure it meets your needs.
